 A top investment bank was investigated by the state Attorney General on charges of Obstruction of Justice.  Client was accused of knowingly destroying documents during an inquiry by the SEC.

Success

Ibis developed a means to capture deletion date information from a standard office email package that was not previously commercially available.  Additionally, Ibis repurposed a component of its core applications to analyze data between two time periods to determine deletion activity. This brand new technology was the first of its kind in the industry.

Scenario - Product Liability

A major pharmaceutical company faced product liability charges.  The scope of the case included a witness list of over 5,000 people.   Both legacy and current data needed to be collected for each person.  This data may still be subject to future product liability cases.  The beleaguered pharmaceutical company looked for a comprehensive solution to managing this massive amount of data.

Success

Ibis consulted with the client on how to handle the internal collection of the data.  Ibis worked with this client on prioritization schedules.  Ibis consulted on the means by which the client could cull and focus the data set for review by the company's outside counsel, including consultation on hundreds of search terms.  Ibis became a member of the company's internal task force for handling this litigation, providing expertise and best practices through the entire process.  Ibis's solution allowed data to flow to several outside counsels' review systems seamlessly.

Scenario - Insider Trading 

A top-ten AMLaw 100 law firm had produced documents from a leading life sciences company in response to allegations of insider trading.  The Ibis competitor that processed the information for the law firm could not account for all of the documents.  The law firm asked Ibis to help.

Success

Ibis worked closely with the law firm client to determine the scope of work that had already been processed.  Ibis developed a customized process to identify the responsive set.  Once this set was determined, Ibis processed the data and returned the unique set in an expedited fashion, allowing the law firm to review and produce additional documents in a timely manner.

Scenario - International Offices

 A global Fortune 100 retail company was engaged in litigation requiring the collection and processing of data from offices in the United States and various European countries.  The review team was located in a European country.

Success

Ibis developed a feature (Time-Zone Normalization) to allow the client to normalize a data set, eliminate duplication and represent in a time zone of the client's choice.  Seventy-two percent of the data was segregated as duplicative.  The data set was represented in a format that was representative of the actual time, an important detail to the email data in the case. Ibis remains the only electronic discovery provider to offer this custom feature.

Scenario - 24/7 Service 

A potential Strategic Alliance partner who was processing data using an in-house tool called on a Saturday and needed to get data to a client on Monday.  The in-house tool was not able to meet the demand.  Additionally, the potential Strategic Alliance partner was concerned with the quality because the data was going to a valued client.  The potential partner asked if Ibis could help them out of a jam.

Success

Ibis responded quickly, mobilizing the proper resources.  A secure electronic transfer site was established.   Specifications were gathered to develop the custom load format.  The data was processed over the weekend and Ibis's Client Services team kept the client informed throughout the entire process, with both phone calls and processing status updates.

Scenario - Non-recoverable Data 

An AMLaw 100 law firm called Ibis on behalf of a client based on the recommendation of a state Attorney General.  The law firm had attempted to argue that the information that the Attorney General was requesting was unavailable or burdensome to obtain.  The attorney general suggested that the law firm contact Ibis because the attorney general knew, based on previous experience, Ibis could handle that type of information.

Success

Ibis's standard workflow process made this information readily available in a format that the law firm could easily incorporate into their selected case management tool.

Scenario - Non-Responsive Data

Ibis assisted a large insurance company in response to investigation directed by the NEw York State Attorney General.  The first phase of processing consisted of 2.5 TB of data including email data for 750 custodians and desktop data for a subset of 200 custodians. Ibis was called upon to cull the data and to assist the client by reviewing Ibis's patent-pending search and filtering methodologies to create search commands that substantially narrowed the dataset, which Ibis then processed to native file.
